Over 1,000 New Tolerance Campaign Activists Demand ACLU Retract False Accusations of Racism and Apologize to College Workers It Attacked

FOR IMMEDIATE RELEASE March 10, 2021 Contact: kon@newtolerance.org Over 1,100 New Tolerance Campaign (NTC) activists have written to the ACLU demanding the organization retract and apologize for its smear campaign of working-class victims at Smith College. “The ACLU has ruined the lives of a cafeteria worker and janitor with false accusations of racism,” stated NTC Advisory Board member Nicki Neily. “The ACLU must do the right thing by making amends to these individuals.” Two weeks ago, the New York Times published a feature exposing the damage done to a Smith College cafeteria worker and janitor after a student claimed that they had racially profiled her – a debunked charge nonetheless championed by the ACLU. Since the expose article ran, NTC has mobilized 1,130 activists (and counting) to send letters to the ACLU demanding a clear retraction and an apology to the workers unfairly branded as racists. At first, the ACLU did nothing. Then, sometime in the past few days, the original article that uncritically reported the student’s false claims disappeared from the organization’s website. Yet other articles remain (here, here, and here), repeating the unsupported claim that the incident was an example of racial profiling. “The ACLU has yet to issue any kind of apology to the people whose reputations they helped destroy,” noted Neily. “An organization that once defended civil liberties for all – no matter how unpopular they may be – has traded principle for a politicized agenda, standing by a now-debunked narrative rather than acknowledging their error. This speaks volumes about their commitment to the civil liberties of working-class Americans.” The New Tolerance Campaign is a 501c3 nonprofit watchdog organization mobilizing Americans to confront intolerance double-standards by establishment institutions, civil rights groups, universities, and socially-conscious brands View the NTC’s campaign to the ACLU here. Tell Amazon: Stop Selective “Woke” Book Censorship

Amazon, by far the world’s largest bookseller, has until recently promoted itself as an open marketplace of ideas, with all kinds of transgressive and provocative works for sale, including Hitler’s notorious book “Mein Kampf.” But on February 21, Amazon suddenly removed any trace of When Harry Became Sally, a book published three years ago by Ethics and Public Policy Center President Ryan T. Anderson. Described as “sensitive” and “fair-minded” by professors at top medical schools, the policy treatise takes a traditional stance on the controversial issue of transgenderism. Amazon did not inform the author or publisher of its decision, and the company has refused to comment on the sudden ban on a book published several years ago. Bizarrely, other books by Anderson are still for sale on Amazon as are books by other authors that take a similar stance on transgenderism. Amazon’s actions suggest that it has adopted an ominous new “woke” censorship approach where certain books suddenly become problematic and disappear. Others – like “Mein Kampf” – remain openly for sale, with no discernable universal standard. Amazon needs to hear from consumers like you that such arbitrary yet highly politicized censorship must stop before it spreads further. Sign the petition demanding that Amazon stop the hypocritical censorship and restore Anderson’s book to its virtual shelves! Update 3/15/21: Amazon issued a statement after several U.S. Senators issued a complaint. The statement claims that Amazon will not sell books that characterize transgenderism as a mental illness. Anderson contends that his book does nothing of the sort.

Lessons from CPAC’s Choice to Let Young Pharaoh Go

Last week the American Conservative Union (ACU) hosted their annual Conservative Political Action Conference (CPAC) under the theme “America Uncanceled” – a name that became somewhat ironic when CPAC canceled one of its speakers just before the conference started. The scandal was sparked by a Media Matters expose on a panelist named “Young Pharaoh” that revealed a slew of grossly anti-Semitic tweets. Within two hours, all traces of Young Pharaoh had disappeared from the event website. CPAC announced a speaker had been removed for “reprehensible views.” Young Pharaoh’s social media included claims that Judaism is a “lie” invented for political reasons, referred to Jewish people as “thieving”, and insisted “all the censorship & pedophilia on social media is being done by Israeli Jews.” After being disinvited, Young Pharaoh doubled down on his anti-Semitic comments and made a video claiming that the ACU reached out to him first and accused the organization of inviting him to have more minority faces in their program. If Young Pharaoh’s allegation is true, it would mark yet another example of how some civic groups overlook one type of bigotry while trying to address another – with anti-Semitism in particular given a pass in the cause of promoting other types of “diversity.” It is unclear how ACU missed the many red flags in Young Pharaoh’s tweets and videos, which often contain conspiratorial content. The larger issue raised by Young Pharaoh’s unceremonious exodus from CPAC is the seeming tension between opposing “cancel culture” and standing up to bigotry. “Cancel culture” is the extreme over-reaction by increasingly woke civic institutions and leaders that seize on a real or perceived grievance to destroy someone’s career. Refusing to give an optional platform to an unabashed anti-Semite, by contrast, is in no way an overreaction. Cancel culture is a problem, but so is overlooking blatant bigotry like Young Pharaoh’s. Opposing cancel culture and having standards are not mutually exclusive. Even those who believe themselves above “woke” traps can sometimes still fall into them.

Tell the ACLU to Set the Record Straight on False Accusations that Ruined Lives at Smith College

The New York Times recently published a scathing critique of an alleged racism incident at Smith College that turned out to be nothing of the sort. The ACLU championed the false claim and has yet to retract its statements or apologize for its misleading campaign that seriously harmed an accused janitor and cafeteria worker. Join NTC in demanding that the ACLU apologize and set the record straight! In 2018, Smith student Oumou Kanoute claimed that white workers called school security on her while she was minding her own business and eating lunch on Smith College’s campus, where she was working over the summer. She claimed that it was a clear case of racial profiling, and the ACLU, Smith College, and many news outlets took her at her word. The ACLU created the “eating while black” campaign, holding the incident up as proof of everyday racism. Three months later, a law firm hired by Smith College found out what really happened that day. A summer camp rented space from Smith College and thus for the sake of child safety, some areas became off-limits to everyone else. A cafeteria worker told Kantoute that the area was off-limits, but didn’t press the issue. A janitor saw that there was an unauthorized person in the area and followed protocol by calling security. A security guard showed up and politely asked her to leave. Kantoute responded by posting the names and pictures of those who supposedly racially profiled her on social media, and the story blew up to national news, fanned by the ACLU. The janitor was placed on leave and the cafeteria worker been subjected to rampant harassment, including people leaving notes at her home calling her a racist. She’s struggled to find a new job because she’s become locally infamous. When the truth came out, the ACLU didn’t back down. According to the Times: Rahsaan Hall, racial justice director for the A.C.L.U. of Massachusetts and Ms. Kanoute’s lawyer, cautioned against drawing too much from the investigative report, as subconscious bias is difficult to prove. Nor was he particularly sympathetic to the accused workers. “It’s troubling that people are more offended by being called racist than by the actual racism in our society,” he said. “Allegations of being racist, even getting direct mailers in their mailbox, is not on par with the consequences of actual racism.” The ACLU makes a lot of noise about civil liberties and equality, but this incident shows they put a preferred narrative over anything resembling equality. The organization should have gotten the facts before spreading Katoute’s narrative, but now that the truth has been revealed, they have a responsibility to reverse the damage as much as possible. Using the form on this page, you can send an email to the ACLU demanding that they retract their previous statements, set the record straight, and apologize to the innocent people whose lives they helped ruin.   Campaign Update 3/10/21: The ACLU has removed the page on their website that uncritically repeats Kanoute’s false narrative, but they have not made a statement or removed other pages on their website that categorize the incident as racial profiling.

Literary Agent Fired for Joining Parler Tells Her Story

In late January, Americans saw one of the most jarring cases of cancel culture yet when literary agent Colleen Oefelein was fired just for joining social media sites Parler and Gab. NTC launched a campaign to stand up for her, and over 3,000 of you have taken action. We caught up with her to get the full story of what happened, how she’s doing now, and what message she wants to share with you.  What Happened? Colleen’s Story  Colleen started working at the Jennifer de Chiara Literary Agency in February of 2018. “I always felt welcome,” she explained. “Sometimes the others would start to talk politics, but I always stayed quiet during those conversations.”  De Chiara encouraged her literary agents to use social media to find new authors, so when Colleen heard that a number of authors had joined Parler, she joined too. Colleen says she posted the same things to Parler that she posted on Twitter – primarily writing tips and animal memes. Her most controversial posts focused on the correct use of apostrophes.   When Parler shut down, she followed some authors to Gab, where she continued to stick with publishing-related content. Out of the blue, she received an email from De Chiara saying that she was fired just for joining those platforms.  “Perplexing” is the word Colleen used several times to describe her firing. She wasn’t engaging in controversial topics. She was just using social media to do her job.  How Is She Doing Now?  When asked how she’s doing now, Collen said “I have a really good support system. I’m mostly worried about my authors I represent and making sure I’m taking good care of them, making sure they don’t suffer any consequences they don’t deserve.” She has had other job offers and is optimistic about the future as she weighs her options.   Toxic YA Hate  Colleen is no stranger to cancel culture and weaponized tolerance. She explained that social media is full of what one of her writers calls “toxic YA hate,” referring to the swift and merciless condemnation writers of young adult fiction experience if they run afoul of the self-appointed inclusion gatekeepers.  Collen says that many of her authors are afraid to publicly express their faith or their political views. “They’re just dead scared that someone is going to find out and blacklist them, and their dreams of being a published author will just go ‘poof.’”  Colleen kept her social media posts limited to avoid this very trap, but it found her anyway.  Her Message to You  “A big thanks and a big debt of gratitude for all of the support. It really it is uplifting.”   She continued, “I hope that I can get the word out about the climate of the American publishing industry. And exposing some of these hypocritical things. Maybe somebody else won’t see their dreams evaporate because somebody gets offended for a stupid reason.”  Moving Forward  Colleen saw firsthand how people are terrified of standing up for their beliefs, whether that be supporting people in situations like hers or just sharing an opinion about current events. More than 3,600 Activists Emailed Disney Saying Firing Gina Carano is NOT the WAY. Disney fired Gina Carano from her role in the Star Wars TV show The Mandalorian over an Instagram post comparing the treatment of conservatives to the Jews during the Holocaust – yet took no action to similarly hyperbolic Holocaust analogies from Carano’s co-star Pedro Pascal. In a now-deleted Instagram post, Carano argued that “to get to the point where Nazi soldiers could easily round up thousands of Jews, the government first made their own neighbors hate them simply for being Jews. How is that any different from hating someone for their political views?” In response, Disney-owned Lucasfilm released a statement saying that Carano was not an employee and would never again be in the future, adding: “Nevertheless, her social media posts denigrating people based on their cultural and religious identities are abhorrent and unacceptable.” Her post does not ‘denigrate’ anyone. Furthermore, Disney met a similarly hyperbolic Holocaust analogy tweeted by her Mandalorian co-star Pedro Pascal – comparing ICE detention facilities to Nazi concentration camps – with silence. Disney has not clarified why it holds her to a different standard than her co-star – or the many Disney-affiliated individuals have compared Donald Trump to Hitler without repercussions. Furthermore, Disney openly partners with a government currently committing genocide against a vulnerable minority. The credits of Disney’s recent live-action film Mulan express “special thanks” to several government entities in Xinjiang, where the Chinese government imprisons citizens in brutal camps because of their Muslim beliefs. Ironically, the company’s over-the-top response seems to validate Carano’s warning about turning neighbors into enemies.

The watchdog organization has launched a new email campaign demanding Disney correct its tolerance hypocrisy. Disney recently fired Carano from her role in the Star Wars TV show The Mandalorian over an Instagram post comparing the treatment of conservatives to Jews during the Holocaust, an admittedly inaccurate comparison – yet took no action to similarly hyperbolic Holocaust analogies from Carano’s co-star Pedro Pascal. The inconsistency follows a recent pattern of concerning ethical decisions by Disney, raising concerns about the corporation’s commitment to uniform ethical standards. In a now-deleted Instagram post, Carano argued that “to get to the point where Nazi soldiers could easily round up thousands of Jews, the government first made their own neighbors hate them simply for being Jews. Stand Up for an Employee Fired for Using Parler and Gab

In a new low for cancel culture, The Jennifer De Chiara Literary Agency fired Colleen Oefelein for having accounts on the social media sites Parler and Gab. CEO Jennifer De Chiara claims she did this in the name of “unity, equality, and social justice.” She has those terms entirely backward. Sign the petition to demand that De Chiara give Oefelein her job back immediately! The news broke via a series of tweets from De Chiara: This leaves little room for doubt that Colleen Oefelein was fired solely because of her presence on these social media platforms. There have been no reports of her posting anything objectionable on these accounts or doing anything that could negatively impact her work, her clients, or her employer’s reputation. There has undoubtedly been unsavory activity on both Parler and Gab, but that is far from the only activity. Millions of decent people have sought out new outlets in fear or protest as Facebook and Twitter have increased their crackdowns on certain forms of controversial speech. The danger here is articulated well by Spiked: “Now anyone who merely uses an app is automatically tarnished thanks to the content others might have posted on it. We have reached the stage of cancel culture where you can be canceled for what others might have said. This is sinister.” One also must wonder what “unity” means to Ms. De Chiara if she finds all 15 million Parler users offensive. The De Chiara Agency’s actions are a legal gray area, but not a moral one. This is exactly the type of thing that causes division and ruins our ability to engage freely with those who have different viewpoints.  Sign the petition demanding Ms. Oefelein’s immediate reinstatement. Joining a social media platform should not cost someone their livelihood, especially not from a company that claims unity as a guiding principle.

3 Things to Watch as We Enter the Biden Era

This week started with MLK Day, when the internet overflows with wonderful quotes from Dr. King about justice, equality, activism, and character. These quotes provide a stark contrast to what we’ve witnessed in our nation over the last year, and especially the last two weeks.  We are nowhere near achieving MLK’s dream. While some things have improved dramatically for our nation, other problems have just changed shape, and new technology has ushered in brand new ways for us to discriminate, bully, and divide. It is a new year, and starting today, we have a new president, but neither of those things will make this nation’s underlying problems go away.  As we move into this next chapter of our nation’s history, the New Tolerance Campaign has pledged to keep a close eye on three big issues: Big Tech Censorship This problem has been simmering for years as social media and search engines try to walk the line between promoting free expression and stopping things like bullying, bigotry, and promotion of violence. No doubt it’s a tough job, but almost all of the major tech companies have systematically failed at anything resembling fair enforcement of clear policies. This has never been more apparent than this past couple of weeks when Trump and many of his supporters were banned from many platforms while other accounts that routinely promote violence and even gross human rights abuses remain untouched. We recognize that these tech companies are private entities that are not bound by the First Amendment, but they have immense power to control the public’s access to information, and it is our duty as citizens to demand that they set fair, transparent rules and abide by them. The American Response to Uyghur Oppression in China American companies like Apple, Nike, the NBA, and Disney love to tell us how much they care about social justice with flashy ads and not-so-subtle messaging. But they only hop on bandwagons that are already popular and don’t cost them anything. Meanwhile, they are completely silent on the extreme human rights abuses happening in China, even while they take advantage of its lucrative consumer market and cheap labor. American government officials have been stepping up in some ways. In the last month alone, outgoing Sec. of State Mike Pompeo boldly accused China of ‘genocide,’ and the Biden campaign returned a donation from a lobbyist with Chinese ties.  This is progress, but it’s not enough. As influencers of social norms, major American companies must act responsibly, which at the very least means acting consistently. They should stop the use of hypocritical slogans and marketing campaigns that encourage poisonous phony tolerance. Anti-Semitism  While the fight against racism makes headlines every day, there has been a baffling amount of anti-Semitism that doesn’t seem to concern mainstream media, advocacy groups, civic leaders, and many public figures. If we mean it when we say as a country that we must end racism in America, that means fighting anti-Semitism just as earnestly as other forms of racism. Yet, some racial justice fighters have been allowed to spout anti-Semitism in the course of condemning other forms of racism. This must end. We have a biased tolerance problem in this country. A phony tolerance problem. We have forgotten how to address our problems in healthy ways. Acts of violence, shouting matches, canceling, and deplatforming – digital or in-person – make our problems worse. Let’s work together to call out biased tolerance in healthy ways so that understanding, compromise, and respect can prevail. If you haven’t checked out our campaigns page in a while, please do.
