New Tolerance Campaign Text Messaging Terms of Service (TTOS)
Effective Date: January 1, 2026
New Tolerance Campaign (“New Tolerance Campaign,” “Organization,” “We,” “Us,” or “Our”) offers a mobile messaging program (the “Program”), subject to these Mobile Messaging Terms of Service (the “Terms”). By opting into or participating in the Program, you agree to these Terms. If you do not agree, you should not participate. You may opt out at any time by following the instructions below.
1. Organization Information and Tax Status
New Tolerance Campaign is a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. The Organization engages in educational and issue-based advocacy activities and does not engage in partisan political campaign activity or endorse or oppose candidates for public office.
2. Program Description
By enrolling in the Program, you may receive recurring SMS and/or MMS messages from New Tolerance Campaign, which may include news alerts, organizational updates, educational content, issue advocacy, event invitations, participation opportunities, donation requests, and other information related to the Organization’s mission. Message frequency varies depending on your interaction with the Organization. Message and data rates may apply.
3. User Opt-In and Consent (TCPA Compliance)
The Program is available to users who provide prior express consent to receive mobile messages. By providing your mobile number and opting into the Program, you consent to receive recurring text messages from New Tolerance Campaign, acknowledge that messages may be sent using automated technology including an automatic telephone dialing system, prerecorded voice, or artificial voice where applicable, represent that you are the authorized user of the mobile number provided, and understand that consent is not required as a condition of making a donation or receiving services. Opt-in may occur through website forms, donation forms, event registrations, keyword text opt-ins, or other enrollment methods. Messages may be sent by New Tolerance Campaign or by service providers acting on our behalf.
4. User Opt-Out
You may opt out of the Program at any time. To stop receiving messages, reply “STOP,” “CANCEL,” or “UNSUBSCRIBE” to any message. After opting out, you may receive a one-time confirmation message. You may also request removal by contacting info@newtolerance.org. Opt-out requests will be processed promptly in accordance with applicable law.

6. Message Delivery and Carrier Disclaimer
Delivery of messages is subject to effective transmission by your wireless service provider and is not guaranteed. Carriers are not liable for delayed or undelivered messages.
7. Fees and Charges
Message and data rates may apply depending on your wireless plan, and you are responsible for any charges incurred from your mobile carrier.
8. Privacy and Data Use
We respect your privacy. Information collected through the Program may include your mobile phone number, name and contact information if provided, and engagement or interaction data. We use this information to deliver messages, respond to inquiries, provide updates, conduct fundraising and outreach consistent with our nonprofit mission, and improve communication effectiveness. We do not sell, rent, loan, trade, lease, or otherwise transfer your personal information, including your phone number, to third parties for marketing purposes. We may share information with service providers assisting in message delivery, to comply with legal obligations, or to protect our rights, safety, or property. 9. 501(c)(3) Compliance Statement
New Tolerance Campaign is a 501(c)(3) nonprofit organization, and all communications sent through the Program are intended for educational, informational, and issue advocacy purposes in compliance with applicable laws governing tax-exempt organizations. The Organization does not engage in political campaign intervention, endorsement or opposition of candidates, or coordination with political campaigns.
10. Fundraising Disclosures
Some messages may include requests for donations. Contributions to New Tolerance Campaign are tax-deductible to the extent permitted by law. Our Tax ID number is: 84-2755642.
11. Eligibility
By participating in the Program, you represent that you are at least 18 years old or have obtained permission from a parent or legal guardian.
12. Geographic Scope and Legal Compliance
The Program is intended for use within the United States. We comply with all applicable federal and state laws governing text messaging communications, including the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and applicable state consumer protection and privacy laws.
13. Dispute Resolution and Arbitration
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Program, such dispute shall be resolved by binding arbitration administered by JAMS in Washington, D.C., before a single arbitrator. Claims of $250,000 or less will be governed by the JAMS Streamlined Arbitration Rules, and claims exceeding $250,000 will be governed by the JAMS Comprehensive Arbitration Rules in effect at the time arbitration is initiated. The Federal Arbitration Act governs this provision. All proceedings shall be conducted on an individual basis, and you waive any right to participate in a class, consolidated, or representative action. If arbitration is found not to apply, both parties waive any right to a jury trial. The arbitrator’s decision shall be final and binding and may be enforced in any court of competent jurisdiction.
14. Limitation of Liability
To the fullest extent permitted by law, New Tolerance Campaign shall not be liable for delayed, failed, or misdirected message delivery, errors or interruptions in service, or any damages arising from participation in the Program.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. Updates will be posted on our website with a revised effective date. Your continued participation in the Program constitutes your acceptance of any revised Terms.
16. Miscellaneous
These Terms constitute the entire agreement between you and New Tolerance Campaign regarding the Program. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure by the Organization to enforce any provision shall not be deemed a waiver of its rights.
